- The Fair Credit Reporting Act, governs background checks nationally, only allows for a review of the past 7 years 15 USC sec 1661 et seq.
- 314.200 RSMo “No board or other agency created pursuant to laws of the state of Missouri, or by any city, county or other political subdivision of the state, for the purpose of licensing applicants for occupations and professions may deny a license to an applicant primarily upon the basis that a felony or misdemeanor conviction of the applicant precludes the applicant from demonstrating good moral character, where the conviction resulted in the applicant’s incarceration and the applicant has been released by pardon, parole or otherwise from such incarceration, or resulted in the applicant being placed on probation and there is no evidence the applicant has violated the conditions of his probation…”.
- Employers cannot conduct background checks unless they first provide a disclosure in writing to their applicants and employees. They must also get their signed permission to conduct the checks before they can do them.
- So what shows up on a background check in Missouri? We typically generate a Closed Records Report containing all criminal history data, including all arrests (filed or not filed charges), charges that have been nolle prossed, dismissed, or found not guilty in a court of law, and will include any SIS after the probation period is completed.
